Spain Implements Three-Year Tourist Ban in Popular Destinations to Combat Overtourism

Spain has introduced a new three-year “tourist ban” in some of its most popular destinations, including Malaga, as part of measures to tackle overtourism and its impact on local communities. The ban, which came into effect on January 14, prohibits the registration of new holiday rentals across 43 districts in Malaga, the capital of Costa del Sol. This move is aimed at curbing the growing number of rental properties in densely populated areas, particularly where holiday lets make up more than 8% of residential blocks.

Despite being dubbed a “tourist ban,” the measure targets property owners looking to rent out accommodations rather than tourists seeking to rent. British holidaymakers can still book Airbnbs, hotels, and other registered accommodations in Malaga, including the 13,000 holiday rentals already licensed in the city. However, tourist flats registered since February 2022 that lack independent access and resources separate from residential buildings will have their licenses revoked.

Similar bans have been implemented in Alicante and Madrid, with other Spanish cities like Barcelona and Seville expected to follow suit. The Malaga ban is likely to be extended beyond its initial three-year term.

In addition to the rental restrictions, tourists visiting Spain this year should be prepared to provide more detailed personal information, including bank card details, family relationships, and home addresses, when registering for car hires or hotel stays. This measure, introduced late last year by Spain’s interior ministry, aims to assist police in tracking criminals but has faced widespread criticism.

The new rules come in response to widespread anti-tourism protests across Spain, where locals have expressed concerns about rising housing costs, unaffordable living conditions, and the strain on natural resources caused by mass tourism.
