The decision not to subpoena Hutchinson was reportedly made during discussions between Johnson’s office and Rep. Barry Loudermilk (R-Ga.), who is leading a Republican-led investigation into the January 6 committee’s work. Loudermilk had initially considered issuing a subpoena to Hutchinson to obtain further testimony and electronic communications, but Johnson’s office expressed concerns that such a move could backfire by revealing the alleged texts and giving Hutchinson another platform to recount her story.

Hutchinson’s attorney, Bill Jordan, did not confirm the existence of the alleged texts but stated that his client had cooperated voluntarily with the investigation. He criticized Loudermilk’s December interim report, which accused former Rep. Liz Cheney (R-Wyo.) of improperly communicating with Hutchinson during the original investigation. Jordan emphasized that Hutchinson stands by her testimony despite efforts by “men in powerful positions to attack her.”

Johnson and Loudermilk have denied that the decision to avoid subpoenaing Hutchinson was influenced by concerns over the texts. Johnson claimed the decision was based on Hutchinson’s willingness to cooperate voluntarily, while Loudermilk stated that his committee did not see a need to issue a subpoena. However, the reports have raised questions about the motivations behind the GOP’s efforts to revisit the January 6 investigation, which critics argue is an attempt to rewrite the narrative of the Capitol attack and target Trump’s political enemies.

The controversy comes as Republicans continue to push forward with their investigation, which has been reconstituted under Loudermilk’s leadership.
