Spain Implements New Measures to Tackle Overtourism in Malaga

Spain has introduced new measures to combat overtourism, with a focus on Malaga, the capital of Costa del Sol, which is a popular destination for British holidaymakers. The city has implemented a three-year ban on registering new holiday rentals across 43 districts, effective from January 14. This measure, often referred to as a “tourist ban,” is aimed at property owners rather than tourists, as it seeks to curb the rising number of rental properties in the city’s most crowded areas, where holiday rentals account for over 8% of residential buildings.

The ban does not affect the 13,000 holiday rentals already registered in Malaga, meaning tourists can still book Airbnbs, hotels, and other accommodations in the affected districts. However, tourist flats registered since February 2022 that lack independent access and resources separate from residential sections will have their licenses revoked. Similar bans have been introduced in Alicante and Madrid, with other cities like Seville expected to follow suit.

In addition to the rental restrictions, tourists visiting Spain this year will face additional paperwork requirements. Visitors must provide more detailed personal information, including bank card details, family relationships, and home addresses, when registering for car hire or hotel stays. This measure, introduced by Spain’s interior ministry in late 2024, aims to assist police in tracking criminals but has faced criticism for its impact on privacy and potential delays at check-in desks.

The new regulations come in response to widespread anti-tourism protests across Spain, where locals have expressed frustration over the impact of mass tourism on housing affordability, natural resources, and local services. The measures aim to preserve the integrity of historic centers while maintaining access for visitors to existing registered properties. The Malaga ban is expected to be extended beyond its initial three-year term, reflecting a broader shift in Spain’s approach to managing tourism.
